Contract Position - Candidate Referral Agreement

  1. TechJobLinks agrees to refer to the Client for possible employment Candidate(s) to perform services based on Client’s requirements.
 
  1. The Client shall pay TechJobLinks for each hour the Candidate works. The rate paid to TechJobLinks shall be $5.00 (USD) per hour.
 
  1. The Client shall pay the Candidate directly the agreed upon hourly rate for each hour the Candidate works.
 
  1. The Client shall send copies of Candidate time sheets with each payment that is issued to TechJobLinks in accordance with the Candidate pay cycle.
 
  1. TechJobLinks retains the right of representation of the Candidate. The Client may represent the Candidate only for the specific project to their Customer.
 
  1. In the event the Client or the Client’s Customer hires the Candidate on a permanent basis. The Client shall pay TechJobLinks 25% of the Candidate’s first year’s base salary as a one-time fee (“The Placement Fee”). This will only apply to Candidate(s) referred by TechJobLinks and employed by the Client or the Client’s Customer. The Client shall pay TechJobLinks within 30 days from an employed Candidate’s first day of work for the Client or Client Customer.
 
  1. Should the Client choose not to offer employment to a Candidate referred by TechJobLinks, the Client agrees for a period of 12 months not to independently offer permanent or contract employment to the Candidate or for a period of 12 months to refer any outside business to the Candidate(s). 
 
  1.  TechJobLinks shall be entitled to 25% of the Candidates first yearly base salary as a fee, plus all reasonable expenses incurred by TechJobLinks associated with recovering (including, but not limited to, attorney’s fees etc.) for any violations of Paragraph 6 or 7 hereof.
  
  1. This Agreement shall continue to be in full force and effect until terminated by either party, upon written notice. The terms and conditions imposed in Paragraphs 6 and 7 shall survive any termination of this agreement. In the event any provision of this Agreement is found to be legally unenforceable, such unenforceability shall not prevent the enforcement of any other provision.
 
The laws of the State of Connecticut shall govern this agreement.
 
Each of the signatories to this agreement acknowledges that he/she has the authority to sign this agreement on behalf of the company whose name appears below.
